There are a number of factors affecting the likelihood of the accident claims’ success.

How Long Ago Was The Accident?
If your accident was more than two years ago, very few solicitors will take your case. If the accident claim has not been settled within three years, it becomes statute barred. Although there have been known to be exceptions to this rule in extreme cases. For example, if you are claiming against someone under 18, the three years only begins once they turn 18. There are other exceptions and accident claim advice should always be sought in regards to matters relating to limitation.

Physical And Mental Injuries
The medical details that your doctor recorded when you were injured will be important in your accident claim. The solicitor will use this record as evidence of the type and cause of the injury and if necessary will obtain another specialist’s medical opinion as the case proceeds. You must have a medical examination after an accident so that valid details can be taken, wither at an emergency department of a hospital or a doctor’s surgery.

The Police.
The police who witnessed the accident or arrived at the scene in the immediate aftermath will communicate with your solicitor. The police report will be used as evidence so your solicitor will gain a copy of this. If a civil case is taking place the police officer may be called as a witness.

Witness Statements
Any people who witness the accident should give a statement to the authorities. If you have a supportive witness statement this will help a lot in a case. However, these statements should never be obtained personally by the injured person. However it is possible for your claims solicitor to obtain the signed statement on your behalf.

Evidence.
The more evidence and information gathered, the greater the success rate. Photographic evidence should be obtained by the claimant of any injuries and damage caused at the scene. Your claim fir injury compensation will be helped if you keep a diary recording your recovery and pain. This should include any activities that you are no longer able to do and the effects it has had on the quality of your life.
